These Terms of Sale (hereinafter "ToS") define the rights and obligations of the parties in the sale of software licenses and associated services offered by D4.FR (hereinafter "the Seller" or "the Publisher"), including the Orbiter software, a Plesk extension for web hosting professionals.

The Client is solely responsible for ensuring that their infrastructure meets these prerequisites before subscribing.
Prices are shown in euros (EUR), excluding taxes. Applicable VAT will be added to the pre-tax amount according to current legislation. Prices may be revised by the Publisher at any time, but services will be billed based on prices in effect at the time of order.
Payment is due according to the terms agreed upon at subscription (monthly or annual). Any late payment will automatically incur late payment penalties calculated at the current legal interest rate.
Orbiter licenses are subscribed for a fixed term (monthly or annually). Unless terminated under the conditions provided below, the license is automatically renewed for an identical period.
In accordance with Article L221-28 of the Consumer Code, the right of withdrawal does not apply to contracts for the supply of digital content not provided on a tangible medium whose execution has begun with the prior consent of the consumer.
However, for first-time subscriptions, D4.FR offers a free trial period or a video conference demonstration allowing the Client to evaluate the product before any financial commitment.
The Client may terminate their license at any time, effective at the end of the current period. No refund will be issued for the current period. Termination must be notified by email to contact@d4.fr at least 15 days before the renewal date.
The Publisher reserves the right to suspend or terminate access to the service in case of non-payment, violation of these Terms of Sale or misuse of the service.
Orbiter technical support is provided exclusively by D4.FR. Plesk (WebPros International GmbH) is not responsible for supporting this extension. Support levels and response times are defined according to the plan subscribed by the Client.
The Publisher undertakes to provide the service with diligence and according to best practices. The Publisher's liability is limited to direct and foreseeable damages related to the use of the service. Under no circumstances shall the Publisher be held liable for indirect damages (data loss, loss of revenue, etc.).
The Publisher cannot be held responsible for malfunctions related to the Client's infrastructure, the Plesk platform, or any other third-party software.
Orbiter remains the exclusive property of D4.FR. The license granted to the Client is a non-exclusive, non-assignable and non-transferable license. The Client is prohibited from copying, modifying, decompiling, disassembling or reverse engineering the software.
Les donnees personnelles collectees dans le cadre de la relation commerciale sont traitees conformement a notre Politique de Confidentialite.
These Terms of Sale are governed by French law. Any dispute relating to the interpretation or execution hereof shall be submitted to the competent courts of Paris, after an attempt at amicable resolution.
The Publisher reserves the right to modify these Terms of Sale. New terms will be communicated to the Client at least 30 days before taking effect. Continued use of the service after this date constitutes acceptance.
